BABLL TERMS AND CONDITIONS OF USE

1. Identification of the Owner

Babll is a digital platform operated by Unai Rubio , the legal representative of the service, acting under the commercial name Unair Games , with registered address at Calle Carretes 19, 5-1, 08001 Barcelona, and contact email unai@unairgames.com .

2. Object of the Service

Babll is a digital platform that allows its users to:

Create, modify, and share content linked to existing board games authorized on the Platform (e.g., community-generated cards or expansions).
Design original board games of the user's own authorship.
Share their games via the "Print and Play" format.
Access tools for board game design and testing.

Unair Games acts as a provider of digital tools and hosting space, without intervening in the authorship or the content generated by users.

Babll does not guarantee the correctness, integrity, reliability, or suitability of content generated by third parties, nor does it ensure compliance with intellectual property rights, legal regulations, or quality criteria. Babll reserves the right to modify, update, or withdraw functionalities and tools from the Platform at any time, without prior notice, to improve the service or protect the community.

3. Registration and User Account

To use Babll, it is necessary to register and create a personal account.

The user declares that all information provided during registration is true, complete, and up-to-date, and commits to maintaining it as such while using the Platform.
The account is personal and non-transferable; the user is solely responsible for all activities performed through it.
The user must be of legal age according to applicable law or have legal authorization from their representatives to use the Platform.
The user agrees not to assign, share, or allow the use of their credentials to third parties, nor to use the account in a fraudulent or illegal manner.
In case of unauthorized use or loss of access, the user must immediately notify Babll to protect the security of the account and the Platform.

4. Content Creation

Users may only create content based on:

Board games whose usage rights legitimately belong to the user, who is solely responsible for proving such ownership or authorization, or
Board games previously available on Babll and expressly enabled for content creation by the Platform.

4.1. Original User-Generated Content (UGC)

Ownership: All content of original authorship created by the user on Babll (including games, cards, rules, texts, graphics, or other materials) is and shall remain the exclusive property of the user.

License to Unair Games: By uploading content to Babll, the user grants Unair Games a non-exclusive, royalty-free, worldwide, and limited license, exclusively to:

Host, reproduce, and display the content within the Platform;
Allow its use by other users according to Babll’s functionalities;
Promote the Platform and its features.

This license will remain in effect as long as the content remains published on Babll.

4.2. Content Based on Existing Board Games

It is not permitted to create, upload, or share content (including expansions, variants, adaptations, cards, regulations, or other materials) based on board games that are not authorized or enabled on Babll, even if such content is offered for free or without profit.
The use of existing board games is strictly limited to the Platform environment and the functionalities enabled by Babll at any given time.
User-generated content may not be commercially exploited without a prior and specific agreement with Unair Games and, where applicable, with the corresponding rights holders.
The user acknowledges that all intellectual, industrial, and trademark property rights over existing board games belong to their respective owners. Content based on these games is used under a limited, non-exclusive, and revocable license, only under the terms permitted by Babll.

4.3. Indemnification

The user agrees to indemnify and hold harmless Unai Rubio, Unair Games, and their directors, employees, and collaborators against any claim, demand, action, penalty, damages, costs, or liabilities from third parties arising from the content the user generates, publishes, or shares on Babll, including but not limited to:

Infringements of intellectual property, industrial property, or trademark rights;
Violation of personality rights or personal data;
Illegal, fraudulent, offensive, or prohibited content under these Terms;
Any other action derived from the improper use of content by the user.

5. Commercialization of Content

The user may not commercialize content generated on Babll unless there is a specific agreement with Unair Games.
The user may not commercialize content generated or shared by other users, authors, or publishers within Babll, nor use it outside the Platform for profit.
Any unauthorized commercialization attempt may lead to content removal and/or account suspension.

6. Prohibited Content

It is prohibited to upload or distribute content that:

Infringes third-party intellectual property rights;
Impersonates identity or reveals personal data of third parties;
Includes hate speech, violence, harassment, or discrimination;
Is illegal, fraudulent, or deceptive;
Contains malware, spam, or unauthorized automated systems;
Is sexually explicit or involves the exploitation of minors;
Promotes illegal drugs or criminal activities.

7. Responsibility for Content

The user is the sole responsible party for the content they generate and publish. Unair Games is not responsible for user-generated content unless it has effective knowledge of its illegality and fails to act diligently to remove it.

8. Moderation and Account Suspension

Unair Games reserves the right to remove or limit the visibility of content that violates these Terms and to suspend or cancel accounts in cases of serious or repeated infringement.

9. Personal Data Protection

The processing of users' personal data is governed by the Babll Privacy Policy and complies with the GDPR and applicable Spanish regulations.

Data Controller: Unair Games.
Legal Basis: Execution of the contract, user consent, and legitimate interest.
Third-Party Data: If a user accesses Babll through third-party publishers, those third parties may process data according to their own policies.
User Rights: Users may exercise their rights of access, rectification, erasure, and others via the channels established in the Privacy Policy.

10. Intellectual Property of the Platform

All rights to the software, design, brand, structure, and functionalities of Babll belong to Unair Games or its licensors. Copying, reverse engineering, or unauthorized automated access is prohibited.

11. Limitation of Liability

Babll is offered "as is," without a guarantee of continuous availability. Unair Games shall not be liable for indirect damages, loss of data, or loss of profits.

12. Account Cancellation

The user may cancel their account at any time. Closing the account does not affect rights previously acquired by other users over legally downloaded content.

13. Modification of Terms

Unair Games may modify these Terms at any time. Significant changes will be notified to users. Continued use of the Platform implies acceptance of the new Terms.

14. Applicable Law and Jurisdiction

These Terms are governed by Spanish law. In case of conflict, the parties submit to the competent courts in accordance with consumer and user protection regulations.
